Recently, the Guizhou Provincial Work Promotion Conference on the Implementation of the Compulsory Reporting System was held at the Provincial Procuratorate, aiming to further promote the implementation of the compulsory reporting system for cases against minors and effectively prevent and punish crimes against minors. The conference proposed specific measures and requirements for promoting the implementation of the compulsory reporting system.
The member units of the joint meeting of compulsory reporting, such as the Provincial Department of Civil Affairs, the Provincial Health Commission, the Provincial Youth League Committee, the Provincial Women's Federation, the Provincial Department of Education, the Provincial Department of Justice, and the Provincial Department of Public Security, attended the meeting.
In May 2020, nine departments including the State Supervision Commission, the Supreme People's Procuratorate, the Ministry of Education and the Ministry of Public Security jointly issued the Opinions on Establishing a Compulsory Reporting System for Infringement of Minors (Trial). The compulsory reporting system was absorbed by the Law of the People's Republic of China on the Protection of Minors, which was revised and implemented in June 2021, and has become a legal requirement. According to the provisions of the above laws and documents, state organs, neighborhood committees, village committees, units in close contact with minors and their staff should immediately report to the public security, civil affairs, education and other relevant departments if they find that the physical and mental health of minors has been infringed, suspected of being infringed or facing other dangerous situations in their work; Accommodation operators, such as hotels, guesthouses, and hotels, should inquire about the contact information of their parents or other guardians, the identity of the check-in staff, and other relevant information when they receive minors for check-in, or when they receive minors and adults for joint check-in. If they find that they are suspected of committing crimes, they should immediately report to the public security organ.
Since the establishment of the compulsory reporting system, the Office of the Leading Group for the Protection of Minors under the State Council has incorporated the implementation of the system into the assessment of national demonstration activities for the protection of minors; The Supreme People's Procuratorate shall establish the system of "every case must be investigated" for compulsory reporting; The Ministry of Education has made special provisions in the Regulations on the Protection of Juvenile Schools; The Ministry of Public Security stipulates that hotel operators receive minors to stay in the "five must", which strongly promote the implementation of the mandatory reporting system. Many teachers, medical staff, residents' committees, villagers' committees and other units and personnel with reporting obligations actively fulfill their reporting obligations, so that a large number of crimes against minors can be found in time and minors can be protected in time.
The meeting held that the implementation of the mandatory reporting system plays an important role in timely discovering and stopping crimes and protecting the legitimate rights and interests of minors. Since the implementation of the mandatory reporting system, it has attracted more and more attention, been promoted and implemented better and better, and the effectiveness of the system has gradually emerged. However, the cases of infringement on minors are still high, with more criminal means and more hidden places, which need to be paid more attention.
The meeting required the member units of the joint meeting of mandatory reports at all levels to improve their ideological understanding, and to implement the mandatory reporting system with an attitude of "can't wait, can't slow down, and can't delay". We should fully gather consensus, give full play to the role of the joint meeting of mandatory reports, carry out broader and deeper cooperation, further improve the communication, exchange and cooperation mechanism, and work together to do a good job in the "second half of the article" of mandatory reports. It is necessary to strengthen supervision and promotion, strengthen the publicity of law popularization and supervision and inspection of compulsory reports, pay attention to training norms, screening norms, disposal norms and verification norms, further compact the main responsibility of reports and promote implementation. We should highlight the distinction between rewards and punishments, further improve the mandatory reporting system, standardize the reward and punishment mechanism, and effectively implement the mandatory system.
