Reward Measures (for Trial Implementation)

Article 1 In order to thoroughly implement the decision and deployment of the central, provincial, municipal and district governments on strengthening drug control, widely mobilize social forces to participate in the people's war against drugs, encourage the people to report drug-related crimes, crack down on drug-related crimes, and reduce the social harm of drugs, in accordance with the Drug Control Law of the People's Republic of China and the Drug Control Regulations of Guizhou Province The Measures are hereby formulated in combination with the actual situation of our district in accordance with the Regulations on the Administration of precursor chemicals and other relevant provisions.

Article 2 Citizens have the obligation to report and expose drug-related crimes and have the right to receive rewards for reporting.

Article 3 The drug-related crimes mentioned in these Measures refer to the drug-related crimes that violate the provisions of laws and regulations and should be investigated for criminal responsibility, given public security penalties or decided on measures related to drug rehabilitation.

Article 4 The term "informants" as mentioned in these Measures refers to citizens, legal persons and other organizations who voluntarily report illegal and criminal activities or clues of drugs to public security organs through written materials, telephone calls, visits or other forms.

The informants referred to in these Measures do not include the public security, procuratorial, judicial, judicial administration, national security, armed police, military, customs and other staff who find illegal and criminal activities related to drugs in other official activities.

Article 5 An informant may report to the public security organ through telephone calls, letters, visits, short messages, the Internet and other channels. In order to facilitate verification and reward, it is encouraged to report drug-related crimes in real name. If anonymous reporting is unable to verify the true identity or contact the informant, it will not be included in the scope of reward.

Article 6 The drugs mentioned in these Measures refer to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine, ketamine, etc. Other addictive narcotic drugs and psychotropic substances, precursor chemicals, original drug plants and seeds of original drug plants controlled by the State are also included in the scope of rewards for reporting.

Article 7 A report center for illegal and criminal drug activities or clues in Honghuagang District, Zunyi City (hereinafter referred to as the report center) shall be established, and the report center shall be located in the office of the Drug Control Committee of Honghuagang District, Zunyi City (Honghuagang Branch of Zunyi Public Security Bureau). The main responsibilities are:

（1） To accept the reports of drug-related crimes and fugitive clues;

（2） Be responsible for the registration, distribution, management, supervision, reply, statistics and reporting of drug-related crimes and fugitive clues accepted by the Center;

（3） Supervise and supervise the work of the verification unit;

（4） Organize evaluation on the role of clues of reported cases in investigating and solving cases, and propose reward opinions.

Article 8 The clue of reporting illegal and criminal activities related to drugs refers to the criminal acts involving drugs listed in the Criminal Law of the People's Republic of China; Illegal acts involving drugs listed in the Law of the People's Republic of China on Public Security Administration Penalties, as well as information related to illegal and criminal acts involving drugs.

Article 9 Reporting the following illegal and criminal activities is within the reward scope of these Measures:

（1） Drug abuse;

（2） Drug trafficking;

（3） Illicit trafficking in narcotic drugs and psychotropic substances that can make people addicted to drugs and substances controlled by the State;

（4） Illegal trafficking of precursor chemicals under State control;

（5） Illegal cultivation of original drug plants;

（6） Factories (dens) manufacturing and processing drugs or drugs;

（7） Clues of major drug suspects at large.

Article 10 Those who report drug-related illegal and criminal activities or clues may do so through the following ways and means:

（1） Telephone report: 0851-28422980 or 110;

（2） Directly report to the reporting center in person, or to the drug control department of Honghuagang Branch of Zunyi Public Security Bureau, police stations, relevant case handling teams and other departments;

（3） Report by letter or other effective reporting methods.

Article 11 The report center shall have personnel on duty to accept the report 24 hours a day, keep the published telephone unblocked, and accept the report clues at any time. In case of receiving a report in person, the staff shall receive it warmly, earnestly, patiently and meticulously.

Article 12 When receiving a tip off, the staff of the tip off center shall truthfully record the content of the tip off and inform the tip off person of their own police number or name, so that the tip off person can consult on the verification and award receiving matters.

Article 13 Other departments other than the Report Center and the police shall accept the citizens' reports and report to the Report Center in a timely manner.

Article 14 The report center shall implement the first responsibility system for the reported illegal and criminal activities or clues of drugs, truthfully fill in the Acceptance Form for the Clues of People Reporting Illegal and Criminal Drugs, which shall be submitted to the relevant case handling departments for verification in a timely manner after being approved by the leader in charge of the Honghuagang Branch of Zunyi Public Security Bureau (by telephone or in writing), And report the verification results to the informant as soon as possible.

Article 15 If the tip off clues accepted are not within the scope of the Honghuagang Branch of Zunyi Public Security Bureau after examination, the tip off center shall promptly transfer them to the relevant departments, and report back to the informant after transfer, and explain the place and unit to which they are transferred.

Article 16 The case handling department shall immediately assign special personnel to investigate and verify the tip off clues that are required to be investigated and verified. If the investigation needs the assistance of other departments, other departments involved in the public security organ shall actively assist, and shall not shirk responsibility.

Article 17 Reporting clues should contain more than three basic elements of drug illegal and criminal activities, such as time, place, personnel, events, and articles. They cannot provide elements of illegal and criminal activities. This reward method is not applicable to suspicious and speculative reports only.

Article 18 Those who report and expose illegal and criminal activities or clues of drugs that have not been discovered or mastered by the public security organs or relevant regulatory functional departments, and are verified to be true after investigation, will be rewarded once according to the details and accuracy of the reported information and the nature, circumstances and impact of the investigated cases according to the following criteria:

（1） For those who report drug abuse, drug driving or shelter others to take drugs, a reward of 1000 yuan (RMB, the same below) will be given to one drug addict for each line of investigation and public security punishment, including 3000 yuan for the decision to make compulsory isolation for drug rehabilitation according to law.

（2） Report people who gather to take drugs. If more than 3 but less than 5 persons are found, RMB 5000 will be awarded; If more than 5 but less than 10 persons are found, RMB 10000 will be awarded; If more than 10 persons are found, RMB 20000 will be awarded.

（3） Those who report the manufacture, smuggling, trafficking, transportation and illegal possession of heroin, methamphetamine, ecstasy, ketamine, opium, marijuana, morphine, cocaine, dolantine, caffeine and other drugs (the amount seized is based on the amount of heroin, and other drugs are converted according to the general formula, subject to detection and identification) will be rewarded according to the amount of drugs seized:

1. RMB 5000 to 10000 will be awarded for each case below 50g;

2. RMB 10000 to 20000 will be awarded for each case above 50g and below 500g;

3. RMB20000 to RMB40000 will be awarded for each case above 500g and below 1kg;

4. RMB 40000 to 150000 will be awarded for each case above 1 kg and below 10 kg;

5. If the weight is more than 10 kg, a reward of 150000 yuan to a maximum of 300000 yuan will be given for each case.

（4） Those who report smuggling, illegal trade, production and transportation of precursor chemicals under the control of the State (the amount seized is based on the amount of ephedrine, and others are converted according to the prevailing formula, subject to the detection and identification) will be rewarded according to the amount seized:

1. For the first category of controlled varieties seized with the amount less than 5 kg, RMB 3000 to 4000 will be awarded for each case; If the amount seized is more than 5 kg, RMB 4000 to 30000 will be awarded for each case.

2. If the amount of Class II controlled varieties seized is less than 200kg, RMB 2000 to 3000 will be awarded for each case; If the amount seized is more than 200kg, RMB 3000 to 20000 will be awarded for each case.

3. If the amount of Class III controlled varieties seized is less than 400 kg, RMB 1000 to 2000 will be awarded for each case; RMB 2000 to 10000 will be awarded for each case if the amount seized is more than 400 kg.

（5） Report the drug manufacturing factory (dens). According to the number of suspects captured, the amount of drugs seized, precursors for drug production, and the amount of preparations, a reward of 40000 to 200000 yuan will be given for each investigated and dealt with.

（6） For those who report other clues of drug production, such as drug production articles and equipment, and uncover drug production cases, a reward of 10000 to 100000 yuan will be given according to the number of suspects arrested, drug production articles and equipment seized, etc.

（7） Those who report illegal cultivation of original drug plants and illegal trafficking of opium poppy shells will be rewarded according to the number of original drug plants eradicated and the number of opium poppy shells seized:

1. For the eradication of opium poppy less than 500 plants or cannabis less than 5000 plants, 1000 to 2000 yuan will be awarded for each case; If more than 500 opium poppy plants or more than 5000 cannabis plants are eradicated, 2000 to 10000 yuan will be awarded for each case.

2. Report illegal trafficking in opium poppy shells. If the amount seized is less than 50 kg, RMB 500 to 5000 will be awarded for each case; RMB 5000 to 10000 will be awarded for each case if the amount seized is more than 50 kg.

（8） 1000 yuan will be awarded to each person who provides clues to capture fugitive drug suspects online; Rewards shall be paid according to the amount of reward offered to those who provide clues and are found to be wanted for major drug crimes.

（9） Report other illegal drug related activities or clues. Reward according to the verification within the above reward range as appropriate.

（10） If the same tip off clue involves different reward standards after verification, it shall be rewarded according to the highest standard.

（11） If the above rewards fail to meet the reward standards specified in the relevant national, provincial and municipal reporting reward measures, the higher level standards shall prevail.

Article 19 Those who report more than one clue of drug-related crimes shall be cumulatively rewarded according to the reward standards; If the same clue is reported separately by multiple informants, the first informant will be rewarded. The order of reporting shall be subject to the record time when the public security organ accepts the reporting. If the information provided by other informants really plays an important role in identifying drug-related crimes, rewards may be given as appropriate.

Article 20 The informant shall truthfully reflect the known clues of illegal and criminal activities related to drugs, deliberately fabricate facts, falsely accuse and frame up others, and the public security organ will investigate the corresponding legal responsibility.

Article 21 If the case handling departments of the public security organs have verified or solved the cases of the people's reports of drug-related crimes and found that they meet the reward measures, they shall fill in and submit the Approval Form for Rewards for People's Reports of Drug related Crimes in Honghuagang District within 5 working days, propose the reward objects and amounts, and indicate the relevant matters, It shall be reported to the drug control department of the branch bureau for review and then applied for according to the financial approval procedure, and a bonus shall be awarded to the informant within one month.

Article 22 The informant shall, within one month from the date of receiving the notice of reward, collect the reward with his or her valid identity card. If he or she entrusts others to collect the reward, he or she shall collect the reward with his or her valid identity card and the entrustment procedures; You can also provide the account number of your or his client's bank of deposit, and the public security organ will transfer the bonus to the designated account number. If it fails to collect within the time limit, it shall be deemed to have given up automatically.

Article 23 The rewards for the ears, eyes, special information and clues provided by the public security organ shall be implemented in accordance with these regulations, and the specific procedures shall be handled in accordance with relevant regulations.

Article 24 The district drug control committee office (Honghuagang Branch of Zunyi Public Security Bureau) shall be responsible for the distribution of reward funds for reporting, and the reward funds shall be borne by the district finance and included in the district drug control budget.

Article 25 Establish special reward funds, strictly enforce financial discipline, and strengthen the management of the declaration and distribution of reward funds. The fund is used exclusively. Accept the supervision of financial and audit departments. If illegal distribution is found, discipline and legal responsibility of relevant personnel shall be investigated according to law.

Article 26 The report center, verification department and relevant personnel shall strictly abide by the confidentiality system to ensure the safety of the informant. It is strictly forbidden to transfer the reporting materials to the reported unit or the reported person. Without the consent of the informant, it is strictly prohibited to disclose the informant's information in the process of verification, investigation, publicity and reward. In case of intentional or negligent disclosure of the informant's information, which causes serious consequences to the informant, the relevant personnel shall be seriously investigated for responsibility according to law and discipline.

Article 27 The staff members of the public security, procuratorial, court, judicial, national security, armed police, military, customs and other departments shall not use the information or clues of illegal and criminal drug activities learned in their job activities to report illegal and criminal drugs through others to obtain rewards, and offenders shall be investigated for legal responsibility according to law.

Article 28 If a public security organ staff member is under any of the following circumstances, he shall be given relevant sanctions according to the seriousness of the case; If a crime is constituted, legal responsibility shall be investigated according to law:

（1） Those who fail to carefully verify the source of the report materials and give rewards to those who fail to meet the reward conditions;

（2） Forge reporting materials, collude with or help others to falsely claim rewards;

（3） Informing the informant to help him escape investigation;

（4） Leaking secrets due to dereliction of duty;

（5） Taking advantage of the information or clues of drug-related crimes learned in job activities to defraud rewards through reporting by others.

Article 29 These Measures are not applicable to the cases where the criminal suspect of a joint crime confesses to the public security organ the facts of the drug offences committed by the accomplice, and the criminal suspect or the prisoner exposes the facts of the drug offences committed by others or provides clues to the drug offences committed by others.

Article 30 According to the relevant provisions of the Regulations of Guizhou Province on Rewarding and Protection of Heroes for Justice, the public security organs shall attach great importance to citizens who may suffer reprisals according to their applications, and take safety protection measures as appropriate to ensure their personal and property safety. The public security, procuratorial and judicial organs shall crack down on those who retaliate according to law.

Article 31 The term "below" as used in these Measures does not include the given number, and "above" includes the given number.

Article 32 These Measures shall be interpreted by the Office of the District Drug Control Commission.

Article 33 These Measures shall come into force as of the date of promulgation. The original Reward Measures for People in Honghuagang District to Report Drug Violations and Crimes (for Trial Implementation) shall be repealed at the same time.
